Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson A 24-year-old man with pericardial mesothelioma has alleged Johnson and Johnson's baby powder caused his cancer. The Oakland mesothelioma case marks the first trial to be held since J&J filed for bankruptcy and spun off its talc division. In the early part of the year, substantial settlements were reached in talc cases in New Jersey and California. Plaintiffs linked their cancer to asbestos in J&J's Shower to Baby and Shower Powder products. What is Mesothelioma? Mesothelioma is a deadly type of cancer that affects the mesothelium the lining that surrounds organs and body cavities. It is usually found in the lungs, but it can also occur in the abdomen, the heart and chest cavity, as well as the testicles. Asbestos is the sole known mesothelioma causing agent, and people who have been exposed to asbestos are at greater chance of developing the disease. The first trial since J&J declared its Talcum Powder division bankrupt began this week and jurors in Oakland, California were emotional when they heard the plaintiff's story. In 2022, the plaintiff who was only 24 years old at the time was diagnosed with malignant mesothelioma in the pericardium. He blamed the cause of his condition to his childhood use Johnson & Johnson Baby Powder. The jury awarded him $25 million. J&J is accused of obfuscating asbestos risks from consumers for several decades. The company has a history of hiding asbestos-related findings from regulators and even funding asbestos tests to get the results it wanted. A number of the company's talcum powder suppliers have been named in these lawsuits and include Whittaker, Clark & Daniels and Imerys Talc America. Many women who used talcum powder to maintain feminine hygiene in the genital area or on sanitary napkins, or condoms have gotten an ovarian cancer and some have been diagnosed with mesothelioma. The lawsuits claim that J&J was aware for more than 40 years that the powder could cause ovarian cancer as well as other diseases, but failed to warn consumers. Mesothelioma symptoms include breathing problems, chronic coughing and abdominal pain, fatigue, and lumps or masses on the abdomen or chest. Doctors can identify the disease by a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays. If mesothelioma has been diagnosed, patients can undergo chemotherapy, surgery, and/or radiotherapy. The surgeons can remove affected tissue, based on the location of the tumors. Certain patients with mesothelioma have a life expectancy lower than five. However, aggressive treatments such as extracorporeal tissue transplantation or the cytoreduction process using hyperthermic intraperitoneal chemotherapy can prolong the life of patients. What is the cause of Mesothelioma? Mesothelioma, as with most cancers, is caused by DNA mutations in cells. These mutations can cause uncontrolled cell growth, which causes tumors to form in tissues. Asbestos is the most common cause of mesothelioma. Asbestos exposure can occur in a variety of industries, including manufacturing, mining, and transportation. Asbestos is typically exposed between 20 and 40 years before symptoms appearing. Men are more likely to develop mesothelioma than females. It is also found most often in those between the ages of 50 and 70. The type of asbestos-related mesothelioma that someone develops is usually determined by where they were exposed. Broken Arrow of mesothelioma patients are diagnosed with pleural msothelioma, which affects the lung. Others are diagnosed with peritoneal mesothelioma. one type of mesothelioma which affects the abdomen. Some patients are diagnosed with pericardial mesothelioma. This is an extremely rare form of disease that affects both the liner (pericardium) and the organ itself. Mesothelioma symptoms include shortness of breath, fatigue and abdominal pain, as well as weight loss. In the later stages of mesothelioma, the tumors can grow to other areas, causing severe discomfort and discomfort. Other symptoms that are common to mesothelioma include swelling of the lung (pleural effusion) and a loss of appetite, difficulty swallowing and a blockage within the small intestine referred to as a obstruction in the bowel. Mesothelioma is a debilitating illness that can be fatal. The trial involving talcum powder in Oakland involved a man aged 24 who was diagnosed with pericardial cancer due to the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos, but didn't warn customers. They also cited a letter in 1998 to a J&J executive which revealed asbestos could be present in their products. This is the latest in a string of major verdicts against J&J. In March the jury awarded $18.8 million to a woman who developed ovarian mesothelioma from J&J's talcum powder. Then, last month the jury in Missouri awarded $55 million in another case that involved the same issue. Seven new cases have been added to the MDL talcum-powder over the past month, bringing to 37,522 the number of lawsuits in the process. Most of these lawsuits are brought by women who have used J&J talcum powder to maintain feminine hygiene. How do I know if I Have Mesothelioma? A diagnosis of mesothelioma can be devastating. Patients should consult a specialist to get the most accurate diagnosis possible and prevent misdiagnosis that could lead to unneeded treatment and let cancer spread more. A physical examination and a blood sample can help to identify mesothelioma symptoms. These tests can be used to determine asbestos fibers in blood or to assess the extent to which a patient's organs are functioning. The most reliable method to diagnose mesothelioma is the procedure of a biopsy. Doctors take tissue or fluids from the affected area, and examine them under a microscope to look for mesothelioma tumor cells. The type of mesothelioma a person has also affects the prognosis of their patient. Pleural mesothelioma, that forms in the thin lining of the lungs, is the frequent form of the disease and accounts for the majority of cases diagnosed. Peritoneal mesothelioma is a type of cancer that is found in the lining of the abdomen, is less common. The pericardial msothelioma, in turn, is a rare form of cancer that occurs in the lining the heart. It only accounts for one percent of all cases. Some of the first symptoms include a shortness of breath which gets worse with time and coughing up blood. Asbestos patients may also experience fluid accumulation in the chest cavity. This is known as Pleural effusion. It can be removed by inserting a needle in the affected area of the chest cavity. In more severe cases, doctors might perform a procedure called pleurodesis, which seals the area to stop the reaccumulation of fluid in the pleura. Getting an accurate mesothelioma diagnosis is the most reliable way to determine a patient's treatment options as well as their survival rate. Surgery, chemotherapy, and radiation are all options. Other options include immunotherapy, which is a kind of treatment that increases the immune system to fight mesothelioma cancer cells and tumor-removing fields, which employ the power of magnets to destroy cancerous cells. A mesothelioma specialist who is specialized can also assist patients in understanding the various mesothelioma types, which determine how aggressive the cancer is and what the prognosis of the patient is. Patients should discuss their history of exposure to asbestos with their physician to determine if they're mesothelioma candidates and find out what types of treatment options are available to them. Mesothelioma is a rare but fatal illness that is caused by asbestos exposure. Asbestos was widely used in many consumer and industrial products including baby powder. In talcum-powder lawsuits plaintiffs assert that exposure to asbestos from inhaling the powder caused them to develop mesothelioma or other health problems. J&J allegedly knew about the dangers of talcum powder and asbestos for decades, but did not warn consumers. Plaintiffs have filed mesothelioma lawsuits against J&J seeking compensatory and punitive damages. The claims have been combined into federal and state multidistrict litigations or MDLs. In 2018 one of the largest trial involving talc resulted in a $4.7 billion verdict for the plaintiff. This was a major news story that set the stage for the rest. In the last month, a judge denied J&J's request to dismiss the lawsuits filed by the state. However, in an attempt to derail the litigation, J&J tried again. LTL Management, a subsidiary of J&J, filed for bankruptcy after the company established an entity to take over its liabilities. The bankruptcy stopped the talc lawsuits of thousands, however, the 3rd Circuit rejected this strategy. The lawsuits brought by the state of Mississippi are founded on the same allegations as the individual lawsuits filed against J&J: that the company's inability to warn of the dangers of ovarian cancer caused by talcum powder was negligent and constituted violations of the law of the state. J&J has submitted its motion to dismiss the lawsuits to an alternative bankruptcy court. A hearing is scheduled for June to decide whether the lawsuits against J&J will be allowed to proceed.
