Mesothelioma Lawyer Files Talc Lawsuit Against Johnson & Johnson

A man who is 24 years old and has mesothelioma of the pericardium has claimed that Johnson and Johnson's baby powder was responsible for his cancer. The Oakland mesothelioma case is the first one to be held since J&J spun off its talc business and filed for bankruptcy.

In the beginning of the year, huge settlements were made in talc suits in New Jersey and California. Plaintiffs blamed their cancer on asbestos in J&J's Shower to Baby and Shower Powder products.

What is Mesothelioma?

Mesothelioma is a lethal type of cancer that affects the mesothelium, or the lining that surrounds organs and cavities in the body. It is most common in the lungs, but can be found in the chest and abdomen cavity. Asbestos is the sole known cause of mesothelioma and those who have been exposed to asbestos are at greater chance of developing the disease.

The first trial following J&J declared bankruptcy on its talcum powder division opened in Oakland, California this week. Jurors were impressed by the story of the plaintiff. In 2022, the plaintiff, who was just 24 years old at the time, old at the time was diagnosed with malignant mesothelioma of the pericardium. He attributed his illness to the use of Johnson & Johnson baby powder. The jury awarded him $25 million.

Symptoms of mesothelioma include abdominal pain, abdominal swelling, abdominal lumps, and persistent coughing. Doctors can identify the disease by a physical examination and imaging scans. These include CT scans (computer tomography), MRIs, PET or X rays.

Once a mesothelioma diagnosis is confirmed, patients may undergo chemotherapy, surgery, or radiation. Depending on the location of their tumors surgeons might be able to remove the affected tissue. Patients with mesothelioma may be given a life expectancy of less than five years. However, aggressive treatments like extracorporeal membrane transplantation and cytoreduction using hyperthermic intraperitoneal chemotherapy can prolong survival.

What is the cause of Mesothelioma?

Like all cancers, mesothelioma is caused by DNA mutations. These mutations can cause uncontrolled cell growth, which forms tumors in tissues. You Tube is the most frequent mesothelioma cause. The exposure to asbestos can occur at work in a variety of fields such as mining, manufacturing construction, and transportation. Asbestos is usually exposed for between 20 and 40 years prior to the onset of symptoms developing. Men are more likely to develop mesothelioma than females. It is also found most often in people between the ages 50 and 70. The type of mesothelioma that a person is usually determined by the part of their body that were exposed to asbestos. Most mesothelioma patients are diagnosed with pleural mesothelioma that affects the lung. Some are diagnosed with peritoneal mesothelioma, a type of mesothelioma that affects the abdomen. In addition, some individuals are diagnosed with pericardial melanoma, an extremely rare form of the disease that affects the lining of the heart (pericardium) and the organ itself.

A lack of breath, fatigue and abdominal pain are all symptoms of mesothelioma. In the late stages of mesothelioma tumors can spread to other areas of the body which can cause extreme pain and discomfort. Other typical symptoms of mesothelioma are fluid on the lungs (pleural effusion) and a loss of appetite, difficulties swallowing, and a blockage of the small intestine, referred to as a obstruction in the bowel. Mesothelioma can be fatal.

The talcum powder trial in Oakland involved a man of 24 who was diagnosed with pericardial mesothelioma due to the use of J&J baby powder. His lawyers claimed that J&J knew that talc contained asbestos, but did not warn consumers about it. They also cited an 1998 letter to an J&J executive that revealed the possibility of asbestos being present in their products.

This is the latest in a string of large verdicts against J&J. In March, J&J's Talcum Powder caused ovarian mesothelioma to a woman. Last month, another jury in Missouri awarded $55 million in the same case. In addition, seven new cases were added to the talcum powder MDL over the last month which brought the total number of pending lawsuits to 37,522. Most of these lawsuits are brought by women who have used J&J talcum powder to maintain their feminine hygiene.

How do I know whether I have mesothelioma not?

A diagnosis of mesothelioma can be devastating. Patients must always consult a doctor to ensure the most accurate diagnosis and to prevent misdiagnosis, which could result in unnecessary treatment and spread of cancer.

A physical examination and blood test could be a good start to identify whether mesothelioma has caused symptoms. These tests can be used to determine asbestos fibers in the blood or to assess the extent to which a patient's organs are functioning. The most accurate method of diagnosing mesothelioma is a biopsy. The pericardial mesothelioma, an uncommon type that develops in the heart's lining, is much rarer and only accounts for around 1percent of cases.

The breath is short, and is more severe with time, and bloody coughing are among the first symptoms. Asbestos victims can also experience fluid accumulation in the chest cavity, which is known as pleural effusion. It can be eliminated by inserting a needle in the affected area of the chest cavity. In more severe cases, doctors may opt to perform pleurodesis, which is a procedure which seals the area in order to prevent the fluid from accumulating in the pleura.

J&J however, attempted to stop the litigation. LTL Management, a subsidiary of J&J has filed for bankruptcy after the company incorporated a new entity to assume its liabilities. The bankruptcy stopped the filing of thousands of talc lawsuits, however, the 3rd Circuit rejected that strategy.

The lawsuits brought by Mississippi are based upon the same allegations of the individual lawsuits brought against J&J. They allege that the company was negligent in not warning of the possibility of ovarian carcinoma from talcum-powder and that this was an infraction of the law of the state.

J&J has submitted its motion to dismiss lawsuits to another bankruptcy court. A hearing is scheduled for June to determine whether the lawsuits against J&J will be allowed to proceed.
